Sale agreement

Hello Experts,

I signed a sale agreement to my brother for 10 Lakhs to sell my house which is on my name. This is part of our partition of properties and he has never paid any amount to me. There was an oral agreement from my mother that she will register 2 acres of agricultural land on my name, which she is breaching now and wants to register on my brothers name.

The house is mortagaged with a bank for 8 Lakhs and additionally ~12 Lakhs spent from my own earnings. The agreement is on 100 Rs stamp paper which is not registered. Agreement says that I need to pay 8 Lakhs to bank from 10 Lakhs received and register the property on his name within 6 months.


 I have following questions:


1) Can I claim my part of land from my mother (Property is not ancesterel)

2) If not, is there anyway I can breach the agreement. (As I mentioned he has not paid any money and he is not having income to pay that much money).

3) What is the weightage given to the witness's statement if they say that I have not received any money.

 

Note : All the properties are in Andhra Pradesh.

And also do I need to pay 10Lakhs if I dont want to register house ??????
