No proper answer can be provided unless all facts concerning the POA are given. These facts include the circumstances, object, purpose and the terms of the POA. All facts need to be revealed in the question and not convenient facts alone as that would lead to an incorrect opinion.

Yes, suit for declaration is a proper remedy. A criminal case may also be filed for breach of trust.

Dear Mr Singh ,
POA was given citing one Joint Development Agreement .The Deed by ABC Pvt Ltd were done benefitting self only.
Owner thought they have been given shifted and would be given Flats but now they know they have been cheated nd want to cancel the Deed.
Moreover Possesion of entire unfinished New premises is with A throught its Attorney.
Can POA register the property in its own name thus Violating all trust and contract .
Does Declaration Suit for Cancellation of Deed is the only olution.
The Property is in Kolkata .

This Case is one of its kind as this is highest level of Crime done by Attorney by transferring Property to Him self. Just imagine Vendor /Landowner thinking that He would get Flat s and being Shifted and in contrast to that His Property has been Purchased by Attorney himself ( By selling on behalf of Owner )
