Sale deed of flat on 3rd floor.

Kindly advice on the validity of the following sale deed:

 

Flat located on 3rd floor

Current stage of construction:1st floor slab level.

Landowners have executed the sale deed. 

Further, Landowners have given development rights to a developer firm(a partnership firm of the landowners)

Construction agreement executed by the developer firm in favour of the proposed buyers.

Sale deed cost- Rs. 10 lacs- to be paid to the landowners

Construction agreement cost- Rs.20 lacs to be paid to the developer firm.

When the flat is not yet completed. How come sale deed coming into the front

without the completion of the building r the proposed flat and the possession being handed over to the purchaser, how can a sale deed be executed and registered in favor of the buyer by the vendor?, please come out with proper detail for proper advise.

The sale deed reads: "Sale of partly constructed flat noXXX measuring 1000 sq ft and undivided share of land measuring- 600 sq.ft.

Dear  RP,

It appears that you could not put up your query properly. Ok fine.  Building seems to be under construction.

If Agreement is entered into between  Developer/Builder/Promoter  with that of purchaser and Registered duly stamped, you are protect because averments contained therein contains consideration price and mode of payment. Pl. read them carefully.  Still if you have queries, pl. right precisely and specifically.

Hello RP

One thing is to be confirmed that, as the Flat is proposed to construct and hence sale deed may not be executed. You might have done  "Agreement to Sale"  and not "Sale Deed" .. plz confirm and reply back wihth details.
