I'm a public servant. In COVID time,
I'm reaching my office and just before entering the office, i assaulted the police. now I'm prosecuted under 353.
they have not obtained sanctions as per 197 crpc.
now my question is
I've not stepped into my office, but I'm joining my office if the incident has not happened. whether it can be considered a public act.
197 comes to play when office done in public capacity. Police hs done unecessary exercise which they ere not required.
