Sanctity of a development agreement

Hi,

I entered into a development agreement with a builder 4 years back. At the same time I hand over the possession of the property to the builder.

Now since it is almost 4 years I need my possession back from the builder. The intention is to secure back the claim on the property. Since I am in UK not able to personally contact the builder. He is also not responding to the phone calls.

If require can I legally entitled for the re-possession of the premises which I handed over to the builder.

Dear Bhushan,

What is the time stipulated for delivery of possession after completion of proposed construction in the development agreement.

If the building commits any breach of the terms, you can file a civil suit and recover damages or you can seek for cancellation of the agreement and seek for possession.

It all depends on the terms of ur agreement.
