School principal deny me to meet with daughter

Page no : 4

Vijay Raj Mahajan (Advocate)     19 February 2018

As a biological father you have right to meet your child although the physical custody is with the mother as per consent agreement between both of you. If your wife refuse you to visit the child, you can still file application u/s 26 of the Hindu Marriage Act, 1955 for seeking visitation order from the Family Court. The provision of child custody and visitation can always be altered with change of situation even if there was an agreement contrary to this the welfare of child cannot be ignored. The minor child definitely want to be in touch with both parents and her mental balance get disturbed if she is not allowed to even meet the father, right of the parents are important but the right of child to stay and meet both her parents cannot be ignored.

So, I visit my daughter at school (Private CBSE) regularly(2 times in a month). My daughter shifted to a new school. The principal is not happy about my visit to the school. Last day the principal told me with anger. "School is not the place to visit your daughter. Make other arrangements. This is your last visit. Don't come again here". Her rogue words hurt my mind so much.

The principal is a tough lady and she always talks me with anger. I want to meet my daughter. Please guide me how to survive in this situation?

While you mentioned that as per the Consent Terms the custody of your child is with the mother, you have not mentioned anything about the access terms agreed between the parties.  If there are Consent Terms for access, you can file Application before the Concerned court for executing the same.  If not, file an application for Modification of consent Terms and seek visitation rights to your child after elaborating the reasons why access was not sought in the first place.

As per the consent terms make arrangement to meet my daughter in a convenient place once in a month. Two or three times they made the visit. Later they denied the visit. Then onwards I started to visit the school to meet my kid. First school authority was very friendly. Kid shifted to another school, the school principal very angry lady.

Take a club and break principals head.  Thats the only way out for you.  No doubt there will be police involvement.  But that is the only way you can make court wake up to your cries.  Someone has to pay the price. Let principal pay the price.  Forget the cases etc, it is basic requirement of teacher or principal to be empathetic.  Unless the child itself has problem meeting you, principal cannot do what it has done. Or you simply take child with you when you want. It is waste going to court, by the time you get favorable orders your kid wont even recognize you. Thinkkk.
