Mandatory or merely directory. The object I feel is nobody can deprive another's rights to life and property wirhout authority from law. Because even the custody has to be judicial if such seizure is to be legal.  Without such safeguard every person can be deprived of these two without any authority. But if a magistrate ignores such a rudimentary requirement of proof and profit, what's the remedy to the victim?
