My wife gave birth to a dead child. I am intending to file a criminal case against the doctor on section 304A IPC. The question is is section 304A IPC applicaple in case of stillbirth ? Can an unborborn child be treated as person in case of culpable homicide or medical negligency ?

what was the reson cited for the babys death ? How can you proce the medical negligence. First decide on these aspects you may succed only if there is a strong proof of doctors negligence.
