Section 323 of Indian penal code talks about Punishment for voluntarily causing hurt—Whoever, except in the case provided for by section 334, voluntarily causes hurt, shall be punished with imprisonment of either descripttion for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both.

Assuming you are talking about Section 323 of the Indian Penal code, the punishment under this section is for those who harm anyone voluntarily. The punishment is either being in prison for one year, or paying the mentioned fine, and sometimes it is both. 

Any person- who has suffered because of another person voluntarily hitting them, and thereby causing serious damage- can file a case under section 323 of IPC against the wrong doer.
