Selling of joint house

Hi,I have a joint house with my brother.I want to move out and sell my share,but my brother don't want to sell,nither he is willing to give my share money.So I want to know can I sell my share to anybody.House is not divided between us.Thanks

You can contact a local advocate and issue him a notice seeking partition and file a PLC petition before Lokadalat and file a partition suit . Unless the share is determined with metes and bound, you can not sell your undivided share.

Better go get the property partitioned and get your share specified and then sell it peacfully

Without knowing your share you cannot sell if you sell then the purchaser may file suit for partition against your brother even though partition is not effected betn you and your brother.

As already suggested, you may approach the Adalat. If the issue is not settled, you may approach the court under the provisions of Partition Act, Of course, it is not mandatory that you should approach the Adalat.
