Seperation period for mutual divorce

Hi.

I have been seperated for 5 month from my wife. (married just over a year). Per my understanding Mutual Divorce requies minimum seperation period of 1 year before filing of Petition and this is mandatory. Per lawyers, we can file it now and decree will be ganted after December. The one year would include the 6 month cooling off period.

Please advise. Does cooling off period count towards mandatory seperation period required for MCD?

1year seperation+6month cooling off period so total 18 months

After 1year seperation u apply for mcd and u get date of 6 month yo come up for second motion and dovorce will be granted

You can file now (i.e. after 13-14 month from marriage) and show that you separated after 1-2 month of marriage.

this way, you can save 6-7 months, if both the party is ok with that.

you lawyer, told you correct that,, now you file 1st motion and then in dec, you get 2nd motion( decree)
