Sequence of events in 498a ... ??

is the following understanding correct ??


IPC 498a - 406 - 323 - 504 - 506 - 34 - FIR


IO said CS is ready and he is gonna file in court

 

1) IO will submit CS.

 

2) the CS + other material will go to Chief Judicial Magistrate.

 

3) CS will be assigned a number (is this case number ?)

 

4) then the case will be allotted to a JMFC court.

 

5) then all the documents on record will be given exhibit numbers.

     (after this the accused will be in a position to get the certified copy)

 

6) then summons will be issued for the accused - specifying date for their presence in court.

 

7) summons will be served. 

 

8) accused will be present in court on the specified date.


anything wrong ??


what next ??

9) then all the accused will be given 1 copy each of CS + witness list + witness statements + summary report + other doc.s, if any.


10) next date will be given (this date is for ?)

when a case no. will be given to this matter ? - right now there is only FIR number.

 

when will court start assigning exhibit number to the individual documents ?

further info :

after the police submit the FIR in court, court gives dates with a gap of 14 days.

in between these dates, on any day, police can file the CS.

my lawyer advised to appear in the court on the very next date of filing the CS by police.

one should not wait for the receipt of summons and save precious time.
