Share in ancestral property

Dear experts.

I was not given my share in acestral property of 3 acres. Now 2 acres has already been sold to a third party. What do i do to get my share of ancestral property

First and foremost please indicate the following details.

1. In which State the property located.

2. Who owned the property?

3. How do you say it is ancestral property?

4. Who sold the property?

5. How are you connected with the ancestral property?

After knowing the above details, I may ask for further information also, before answering your query.

Issue notice for partition and mention that the sale of ac2-00 is against law and illegal. and file partition suit and declaration of sale as void.

2. Who owned the property?   Ancestral property (HUF)

3. How do you say it is ancestral property? As per kerala joint family act

4. Who sold the property?  The other members of family

5. How are you connected with the ancestral property? Iam also part of the HUF.

Dear Mr. Prashant,

I think you are getting confused between Ancestral Property and HUF Property.

While both are coparcenary properties, both are separate species.

If you are talking about HUF property, then the 'Karta' only will be selling the property and not others.  Therefore, you have to come out with clear facts, which I am afraid at the moment is lacking.

Dear experts,

Sorry for the confusion. I have clarified that its ancestral property (Tharavade sothe) and iam entitled to it as per kerala joint family abolition act. Kindly advise do i file a suit to do the partition again, in that case what would happen to the property already sold to third party.

In spite of taking all the advice you need an advocate to file your case. Approch an advocate at the earliest and follow accordingly.
