Hello To all law gurus,

My brother was born in a Hindu Brahmin family. I am one out of the three children born to my parents. He converted to Islam when he0 was 20. My father has 3 houses which he purchased during his lifetime. He died without making a will. Can my brother  claim his share in these houses afer his conversion?

As there  is no will he can claim his share in your father property. As a son he has right in the said property.

Conversion to Islam will not take away the right to inherit father's property. Your brother is entitled to his share.

A convert from Hinduism does not incur any disqualification qua his/her rights in the ancestral property or the self acquired property of his parents. Notwithstanding his conversion, your brother has, in the absence of a will by your late father, an equal share in the self acquired property left by him.
