Should i fight for my son's rights?

I took divorce by getting minor alimony and no alimony or maintenenance for my minor son. as  my minor son has right in my ex husband's ancestral property, Should I claim for that from my ex?

my family says if I file a case, that will take long time and lawyer will charge so much that the property my son will get will be of no use then so I should not claim anything. But I want to fight for my son's rights but I can't fight for so many years.

So I want guidance from experts on this forum that how long these type of cases linger and how much a lawyer charge for 1 hearing.

please help me and guide me waht should I do?

All these things depends upon facts and circumstances of every case.  There cannot be a generalised time span that can be stated. Better consult a local lawyer and speak to him. Whether you should fight or not should depend upon the value of the property your son will get if you seek partition.

thanks archana mam. my in-laws have 2 houses worth 25 lakhs approx. each so how much should I claim for my son? can my son get 50% of property or 1 house in his name? also I want to know from your experience that how long these type of cases linger on as I m already divorced and not taking any monthly maintenance for my minor son.

for getting you sons share in your husband ancestral property there is no need for you to file case but talk to your husband and convince him to right one property on your sons name and stay in that house

but mahesh sir, me and my husband had laready taken divorce and we are not in talking terms now. so i cannot call him.

also i want to know that legally how much share my son can get in his father's ancestral property?
