Society as consenting party

We are a registered Co-Operative Housing Society Ltd and the owners of the entire plot which has been leased out to various members of our society for a period of 999 years.

 

Some of the Lease deed’s pertaining to the above mentioned plots are not  Traceable.

 

One of our member intends to sell/transfer his plot to a prospective purchaser/Transferee and has requested that since his original Lease Deed for his plot is not traceable, we the society become a “CONSENTING PARTY/confirming party” to the Deed of Transfer.

 

We request you to kindly give your valued opinion on the above said matter.

if the deeds are not traceable, being long term lease [ more than 1 year], those might have been registered with Sub registrar.... a certified copy of those lost deeds could be obtained from Sub registrar... ... even there is no harm if theb co-operative society becomes confirming party in the deed, as it may not have any objection for transfer.. whether any restrictive clause in the other / similer deeds or bye-laws provides otherwise... take decision after considering these....
