Society share certificate

Dear Members,

Greetings to all.

I have a question to clear.

In my society there are many cases in which the name in the agreement is different from the name in the share certificate.

For instance:  in one case the flat is registered in the name of a single name say Mrs. Y, whereas the share certificate issued by the then society office bearers as Mr. X and Mrs. Y. where as Mr. x name is no where in the agreement.

Now we have formed a new committe and want to resolve such issues Ie remove the name of Mr. X from the share certificate and keep only the name of Mrs. Y , (as it is in the agreement).

Please guide us

You may go thru the Act/Model Bye laws applicable in the state and society bye laws framed in accordance with these…

It shall be better to retain senior LOCAL counsel of unshakable repute and integrity specializing in society/civil  matters  and well versed with latest citations, LOCAL applicable rules/laws/society bye laws  … and having successful track record…. and worth his/her salt…..and show the case related docs etc etc for proper guidance and help..

Society can decide to include the expenses for consultation/retainership etc

In the meantime you may go thru applicable Act/Model Bye laws e.g;

MODEL BYE – LAWS OF COOPERATIVE HOUSING SOCIETY
