I had applied for Maintanance at the local family court here in 2003 and and end 2004 interim got granted. My husband initially paid the interim fro 18 months and later on ( How?iam not sure about it) dragged the cae till mid june 2009. I found something fishy changed my advocate anf he was produced in the witness and and last I was granted Manitanace for myself amnd my younger son since my elder had attained 18 by then om 2nd january 2010. He has benn and NRI since 1992 and we had joined him from 1994-2002. He is still an NRI. There as no response from him regarding the arrears of interim payment as well as the final one. So we approached for execution and they sent an Arrest warrant to his permanant Residential Adress as he had mentioned in his witness. As soon as the said warrant reached his advocate came with an vakalatnama in which his signature is forged. Am not aware how to approach the court to prove his signature is forged since if he is called he would say it is his.
I would like to prove the court that this signature is forged by showing that he was not available in India during that period of time. I came to know through sources that he was not here for the whole 2010 but cannot prove it.
Is there any way /section in law book through which I can approach the cpourt to examine his signature?
More over we all know and so does his family that he is remariied and staying in Nigeris with an Ugandan and has a child in her. But we have no proof of evidence other than snaps of his with his daughter and his wife with daughter.
I have two children who are getting educated and are into college and the whole pressure is on my brother who helps us against my mothers will.
Plaese help me with some suggesstions so that i can get some justice.
I have given applications to MEA and they have forwarded it to Uganda. But he is in Nigeria. I do not have enough funds to send all documents again.
I have through email informed the that I have found his whereabouts but again not with proof.
