Special leave petition

Dear all,

 

I need your help with my case. I owned a car some years back which i sold out. The new owner sold it out further. The present owner of the car was involved in an accident. I was also made a party in the case at the motor vehicle tribunal. I was obviously acquitted as no case was made against. I was able to prove transfer of vehicle to the tribunal. The case went to high court and I was acquitted at the high courst also.

 

Now the case has gone to supreme court by special leave petition and I have been made a party again. I do not understand the reason for that since I am not involved in this matter in any way as has also been said in the judgments of the tribunal and high court. The matter is between the insurance company and present owner and should be fought by them then why am I being involved in it? i feel harassed by the system.

 

Kindly advise me as to how should I proceed and what application should i file with the supreme court so that i may be removed as a party to the case. I have a hearing before the registrar. what should i explain in this case.

 

I will be extremely thankful if you could direct me in the right direction in this case.

Dear Friend,

 

You are made party to the SLP because you were party before the Tribunal and the High Court. You have nothing to worry as you are just a formal party and there are no prayers against you. You may authorize an Advocate to represent you to make sure that by no wild imagination you are subject to hardship.

 As you have said, you had sold your car long back; you should not have been made party at the first place. Either the transfer is not effective or some serious error on part of the insurance company. You can also ask your Advocate in the Supreme Court to make an application to Court that your name shall be deleted as the party.
