I am a doctor , working in a psu ,was preparing for superspecialisation couses, few months back when adv came for the course came I approached my employer ( with an application bearing office no and date) to get NOC since I am under employment, so that i can compete, but my employer suggested why dont you apply under the sponsored category reserved for doctor under emplyment so that the possibility of getting it increses, getting encouregement I ageed and gave a fresh application so that I can compete under the sponsored category, employer issued me an certificate and after the entrance now I am selected, but luckily or unluckily the open seat remaine vacant since no one turned up for the interview round, but I can not now change the category. my employer is denying of paying me any salary during the study period and the college is not going to pay since I am sponsored by the psu, to add on that the psu is putting a bond of 8 months salary to return if I dont serve it for 5 yrs aftrer retun.
Now I have few questions-1. is it legally correct, sponsored without pay but still bond obligation since you have been sponsored , the standing orders my company allows this
2. Personally I found a lot of variations in different psu regarding their rules govering the study leave and the bond terms and conditions, so once i sign the bond can these comparative data with central govt rules and psu stand incourt of law or once bond is signed it is between two parties so later on nothing can be done
3. i am little bit forced to sign the bond althogh i dont agree with all the terms and condition also not much time left to join the couse else i ll miss the admission, can signing a bond under this circumstances be questined later on in court of law ( once after i get relived and join the couse on time and explain the circumstances in which I signed the bond) if i go to court now , till the matter is subjudice my emplyer will not ask me to sign the bond and relese me , so the very purpose higher education is hamperd.
