Stamp duty for succession certificate

One of my relative's case is going on for getting succession certificate. It is at the stage where the Stamp Duty has to be paid for the value of the property. The value of the bank account  is about Rs. 4 lak. This is in Maharashtra jurisdiction. The lawyer is asking for lumpsum 6% of the total amount. Which act is applicable for this calculation? What are the slabs for the calculation of the stamp duty? Is the calculation of asset value done on the date the stamp duty should be paid or when the case was filed? The case is going on for a long time so there is a big difference between both the amounts.

You can get the correct amount of stamp duty from court or local lawyer.

You should have faith in your lawyer, however, if you do not believe him, change immediately.

Thank you very much for all the help provided by the experts. Can anybody tell me which law to check to determine the amount of stamp duty? Is it Maharashtra Court Fees Act 1959? But it does not state amount specifically for Succession Certificate.

Do you mean stamp duty or court fees?  The court fees rate according to Indian Succession Act are as follows:

< 1000  = 0

1001 to 50,000   = 2%

50,001 to 2,00,000  = 4%

2,00,000 to 3,00,000 = 6%

Above 3,00,000 = 7.5%   Max: 75,000

This is in Maharashtra also. Follow the advice of Dr. J. C. Vashista. In any case change your lawyer.

Sir, is this Stampduty percentage arr confirm and applicable in entire Maharashtra. Sir, can you please provide cite or any documents supporting your claim of this stamp duty percentage.
