Statute of limitation in credit card cases

 Is it true that the application of the statute of limitation , regardless of the time lapse or absence of acknowledgement of debt after the limitation period has to be determined by the courts based on merits of the case? Can the Court opine even after the limitation period that the debtor is bound to pay?

The lender shall endeavor to prove the limitation has not set in and debtor is at liberty to establish the claim is barred by limitation.

Bar by limitation does not neccessarily that court can not be approached.
