Learned senior counsel appearing for the applicant has brought to our
notice a letter dated 9th August, 2010 written by the Chief Wildlife
Warden, Orissa requesting the Principal Secretary, Forest & Environment
Department, Bhubaneswar to not sanction permission to M/S Tata Refractories
Ltd., for carrying out mining activities covering 58.50 hectares of forest
area within Chandaka Wildlife Division in Cuttuck District. He submits that
the said letter is still pending for consideration of the Government for
the last about two years.
Learned senior counsel has further submitted that the mining
operations of the applicant remained suspended since February, 2010, even
though requisite deposits have already been made. He further submits that
the State Government is neither deciding the representations of the
applicant, nor sending its views to the M.O.E.F. and not permitting the
applicant to resume mining operations.
Having regard to the submissions made by learned senior counsel, we
direct respondent Nos. 2 & 3 to consider the request of the applicant as
expeditiously as possible and dispose of the same within a period of two
months from the date of receipt of this order.
The Registry is directed to transmit a copy of this order to
respondent Nos. 2 & 3.

This is an application seeking reconsideration of this Court's order
