Stop payment of cheque

My wife filed 498 against my family . Me and my wife used to stay at Kolkata away from my parents . Still she put ally the names . Now police took me im custody for 5 days . During which my dad was harassed and threatened and in laws took 5 post dated cheque as alimony with a deed of understanding signed stating about the cheque as alimony with 5 witness aign. Now I have got bail and parents got absolute bail . Can we stop payment the cheque without attracting NI 138 . What should we do . How can the society decide the alimony Moreover how can we file MCD even if we have not stayed seperately for a year . In laws have played a game . Please help and advice . Thank you .

This is no existing liability, so you can certainly issue stop payment as far Negotiable Instrument Act is concerned.
