Subject: legal advice on workplace harassment and discrimination case at amazon

Dear Members,

 

I need urgent legal advice regarding an ongoing situation at my workplace (Amazon). I have been subjected to both caste-based discrimination and s*xual harassment by a colleague, Atik Kazi, a Muslim, who has made false allegations against me. He has blamed me for starting untouchability in India because I am from the Brahmin (upper caste) community. He is also using my personal condition of diabetes as a means to target me, along with s*xually harassing me.

 

The situation has escalated to the point where I am being blackmailed with threats regarding my s*xual preferences, which they are using to manipulate and harass me emotionally. I have also been informed by my management about an incident during training, where I was involved in a verbal conflict that I believe was instigated by this colleague. Despite this, the response from Amazon management seems more focused on maintaining workplace decorum rather than addressing the harassment.

 

I am a divorcee, and I believe my personal life is being used as a tool for exploitation in this case.

 

I would like to know:

 

The legal steps I should take against caste-based discrimination in the workplace, especially under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

How to approach the Internal Complaints Committee (ICC) at Amazon for s*xual harassment and blackmail.

Any legal recourse available for defamation or blackmail under the Indian Penal Code.

Advice on how to deal with the workplace discrimination related to my diabetes condition.

Your guidance and advice will be greatly appreciated as I am struggling to navigate this deeply troubling situation. Thank you in advance for your support.

To complain about workplace s*xual harassment, you can submit a written complaint to your company's Internal Complaints Committee (ICC), which is usually accessible through your Human Resources department, detailing the incidents of harassment, including dates, times, and witnesses, and requesting appropriate action; you can also use the online platform "SHe-Box" provided by the Indian government to file your complaint electronically. 

Keep a detailed record of the harassment including dates, times, specific incidents, and names of witnesses. 

Reach out to your HR department to inquire about the complaint process and to access the necessary forms. 

SHE online portal allows you to file a complaint directly to the concerned authorities. 

In your complaint, clearly state the nature of the harassment, the harasser's identity, and the impact it has had on you. 

Consider talking to a trusted colleague, friend, or legal advisor before filing a complaint.

If you have strong evidance you can file the complaint but posting names and incident may bring you to trouble of defamation better proceed through proper course by submmitting complaint to your supervisor

The law provides for Prevention of Sexual Harassment for Women at work place, what is your concern ?

Similarly can an upper Caste (Brahman) invoke provisions of Scheduled Caste and Scheduled Tribes (Preveniton of atrocities Act) ?

Management and colleagues are using/or misusing  both laws to single out me and form group to defame me further. I have diabetes so make food confusion to kill me. What to eat what to not eat .  OK..
