Succession Certificate procedure

Please explain the procedure for obtaining Sucession Certificate/Letter of Administration (Christian).

There are a very large no. of heirs to some ancestral land of ours. A few heirs got together and sold the land off to a builder.

The purchaser now wants to pay some money to the remaining heirs to get full rights to the property. He therefore wants a Letter of Administration/Succession certificate to ensure that he will be getting full rights of all heirs.

I understand the Court will send notices to all heirs (including those who have already sold the property illegally w/o informing others) and also put an Ad in the newspapers.

1. Are the concerned heirs required to respond?

2. What about those who have already sold ? Do they have to respond?

For the purpose of selling landed property, you require legal heirship certificate from the tehsildar of the place. In order to get money in deposits of the dead man m you must apply to the court for succession certificate. For the purpose of managing the affairs, you must approach the persons appointed by the State Government to deal it.

Thank you advocate Haridasan. We will definitely take formal legal advice when we reach some ppsitive stage.

Right now I want to understand the process and whether the whole thing is possible.The purchaser stated he wants a Letter of Administration.

Since this involves 20-30 persons, I want to understand the procedure, before wasting my time.
