I am facing a frivolous recovery suit. Issue still not frame in the case. However other party approach the court to amendment the plaint but later withdraw it. Can i file suit for damages.

I am facing a frivolous recovery suit. Issue still not frame in the case. However other party approach the court to amendment the plaint but later withdraw it. Can i file suit for damages.

no application for amendment shall be allowed after the trial has commenced, unless the Court conies to the conclusion that in spite of due diligence, the party could not have raised the matter before the commencement of trial.
