Summary cases

Dear All eminent lawyers/Advocates,

I came across a case that the company received a Summary Case from small causes court without any court notice etc.. And the party was asked to pay about Rs 16 laks for their outstanding etc..etc... Before this both the parties had some notices for the difference in the accounts and both denied the others allegations etc..

Now the court has given only 10 days time to pay else they will pass the Decree etc..

Is it possible for the court to pass such an order without hearing the other persons arguments 

 

Please help...

There is some misconception with respect to law/ legal procedure.

Court notice/summons are a must to direct the defendant to file his/her reply. Straightaway no orders can be passed by any Court in India/Globally.

Consult a local prudent lawyer with all documents for proper analysis, opinion, guidance, advise and proceedings.
