Summon from addl cheif juducial magistrate to nri

Today I have received a summon issued from an Addl. Cheif Juducual Magistarte in my name as well in the name of my wife. Reson is not written.

I am NRI and living in Saudi Arabia. Last year November 2011 I visited India and lodged police cmplaint against my sister who trespassed my house and grabbed one room.

The summon has been received by an unknow person at my residence (occupied by my sister) in India and has sent the same by courrier to me by giving address of my fathers shop.

Manager of my shop dosnt know anything.

Can someone else receive the summon for NRI at Indian address?

Sending from someone else address is ok?

Is it legally challenging matter?

In that summon the case number must have been given you can ask anybody to check the state of the case and get all papers relating to the case.

Mr. Aftan Alam, As-salaam-ale-kum. First of all if you are holding a job or business in Saudi Arabia and visit India for vacation etc then you are NRI but not holder of dual nationality so that you can leave India for ever. You are very much Indian and if involved in a crime then normal criminal proceeding can be initiated against you like any Indian Citizen living in India. If you can show through the Passport pages that you were not in India when the crime was committed then no problem but that chance would come only when you would be asked to submit evidence and that will be very late because generally in India defense evidence is taken when all the evidence are over by the prosecution. If you do not receive the summons etc through normal channel then they can be pasted on your residence door. You can avoid arrest till you do not visit India and pass through air port. So please try to explain the situation to some lawyer at your residence and advise him to do the needful.
