Summon reg

sir,my friend's husband filed the divorce notice,she recieved  her first summon from court,but she didn't attended,one and half months passed,but not yet received the 2nd summon,Is the court send the summon notice for 2nd hearing,without notice she go to attend the hearing or not? Why they didn't send the summon? plz clarify,

when she recieved the summon then why the court will issue another summon it will be better to appear before court otherwise the matter will be heared ex party.

If the first summons is duly served then, the court will not send second summons for the hearing. She should appear in the court in the next date.

tell your friend immediately go to the court with your summons with you and from the office of family court you can get the status of your case like next hearing date etc. after showing your summons to them . She will not get another summons as she had received earlier .

Hello,

If the Court has already sent a summons and it was not answered by your friend, then the Court may send another summons subject to its own wishes. So the Court may or may not send another notice. In cases where the opposite party does not appear in court, the Court can pass an ex parte order in favour of the party present in Court. In your friend's case, if she does not go to the court when the hearing is fixed, then the court might pass an order which will not give any alimony or maintenance to your friend. It will be best if your friend finds a good lawyer who can represent her in court and get a good settlement for her from the husband.
