Summons served through embassy

What are the next steps if the summons served through indian embassy in US are not delivered due

to the person not present at the time of deliver?

What are the next steps by the embassy?

1. Would the summons go back to India?

2. Or is the Indian embassy is going to retry?

3. Or is Indian embassy is going to seek US justice department help?

For a frivolous  Case what is the protection for such summons in US.

My experience tells that summons would have came through Registered Post at your U.S. address and usually post man left a notice saying that "WE MISSED YOU, COME TO POST OFFICE WITH THE RECEIPT AND CLAIM UR MAIL", if u didn't claim this then the status would say "UNCLAIMED" and it will go back to the same channel it came through. If it came from indian embassy then it will go back there and then forwarded to ministry of home affairs which in turn will send the mail as unclaimed back to the court.

1) Yes summons will go back to india

 

2) No there is no retrial by indian embassy

 

3) No indian embassy will not do that

Dear friend,

             Thank you verymuch for your response. Your advice is helping an innocent family.

What are the repercurssions for sending the package  back as "UNCLAIMED".

What could be the next steps?

Close acquaintance who is a lawyer, with jealosy and greedyness cheated and used

the loopholes of the law in India and got exparte decision in India.

That greedy person foundout the address of this person in US and  trying to serve the summons through embassy.

Fortunately for the first attempt no one was at home and the package is returned. Is it OK? Can it comeback

more complicated?

What is the best way to tackle this situation?
