Tangedco's demand notice

TANGEDGO has issued a demand notice for Rs. 84260/on the service connection for common areas of our Apartment for payment of dues for the period 2015 to 2021 towards electricity consmed on  temporary connection takenn by the a builder  to construct our 22 apartment complex. This amount includes penalty @ Rs 1.5 per month.The Association is  regulrly paying  for common area service connection which is still in the name of land owner and is trying for name change.

    The builder is abscondiing. The land owner who lives in America was the joint venture holder and signed for the temporary connection.  As a part of joint venture he was entitled 4flats for free construction and also got  the cost of UDS values from 18 flat owners. He re-sold 3 flats and is holding 1 flat with separate S/C. 

We gave an application to the authorities concerned requesting o collect the dues on the land owner flat's sevice connection as he had signed for the temporary connection. Our request has been turnned down and have been issued notice that the common area service will be dis connected if not paid before due date..

 Can we aproach the court of law on the following grunds?

1. Why the temporary connection was not disconnected when the bill was not paid in 2015 and  demand notice issuued to buider / land owner?

2. Why the demand notice issued after nearly 9 years that cost huge penalty charge  and ask the Association  to pay for it?

You cannot get any justice from court if you appraoch court without making the payment to the electricity department.

You may have to first pay the amount and due amount on behalf of the builder and the landlord and then file a recovery suit against them to recover the same through court of law, you may not  get any relief from court or the department concerned other than following this suggestion. 

The department will not answer to your questions neither the court will direct the department to answer the questions raised by you.

If your association is not paying this arrears  amount then the department may take action as per prevailing law in this connection
