Tenane eviction

Hi,

I am having a tenant in my home for about 40 years.. The tenancy was given to his father with the rent of just Rs. 40. Now his father is dead, and I have stopped taking rent from him since then. I have asked to evict the place he claims he will take huge amount of money to evict the place. Any suggestions how can I get the place evicted, or is it legally possible to ask him to pay rent according market rate?

you cann file a petition to fix a fair rent petition before the court. .

it is the bounden duty of the tenant to pay the monthly rent to you

or

he has to deposite the rent before the court

you can file a eviction petition on the ground of willful default monthly rent

in short you should approach you advocate and discused him he will help you either evict the tenant

or

collect the fair nent

THanks for your reply.. He does send the rent of 40 rs per month, after an interval of 6-8 months through money order which I refuse to take and then he submits that in the court. Where after one or two hearings Court asks me to take the rent else it will be kept in court. But the issue I wish to either increase the rent or get it vacated. I wanted to know what are the chances of me achieving any of these as I discussed the same with some people and they told nothing can be done I will have to live the same way as the court always favours Tenant and if the rent is below 3500 nithing can be done.. Court is against the landlords

You can not increase rent and eviction is allowed for a narrow band of reasons.
