tenant did not pay advance

hi my tenant in bangalore has not paid any advance since His occupancy from 1st june 2015. He has not yet paid the rent for the last month. We did not make rent agreement as we were waiting for the deposit. I do have his PAN and election Id copies. I would like to have him vacated. How shall I proceed. Thank you.

If the default in rent is for three months then you can send a notice to vacate on griunds of default of rent otherwise send a notice asking him to vacate as you need the premises for your bonafide personal use

If I send a notice, within how many days should he vacate? Can he go for a legal fight and buy more time?

U made a mistake of not making agreement. 1)Any way remove him politely. He is likely to create further problem of not vacating. 2) If u want, make LL agreement for 11 months n remove him 3) Legal notice as tress passer 4) Take police help to vacate 5) Take Prominant Party politician/president`s help to vacate 6) Suit for dispossession. Do not worry u r legal owner. Hope u will appreciate
