Tenant of shop has disappeared

We have a 8'×6' shop in our nearby market. We had given the shop on rent. There is an agreement of 5 years between us and the shop tenant. Now the tenant has fled in last March without telling anybody. The shop is locked and key is with the tenant. The shop is a gold jewellery shop. The tenant is absconding for indefinite time. What can we do in this situation? How can we get the shop in our possesion?

Since the tenant has defaulted in rental payment continuously for a period of two months or more, you can issue a legal notice to vacate the rented premises for the same reason.

Let the notice be returned undelivered, you can immediately file an eviction suit, get an exparte order and with the help of court ameena you can get the shop break opened and occupy the same by applying due process of law
