Tenant problem

 

Hi,

        Few years back my father expired and the property which is holding by my father was taken over by my mother with a WILL wrote by my father. A tenant is staying from past 25 years ( its a shop) in that building. Recently on june 2013 a rental agreement signed by my mother(owner) and tenant on a Rs.100 stamp paper. Rent is Rs.3100/- . For a period of 3 years. In that it is wrote not to do any modifications and any illigal in premesis. If any did need to vacate immideatly. From past few months rent not paying in time. In addition modifications (like tiles to floor, A/C, cealing to walls etc) he did in premisis. To run A/C he took power from neighbour building illigelly to my premisis.

       Please suggest me the procedure and action need to take on him to vacate. He is running electrical business.

Give a legal notice to the tenant terminating his tenancy and to vacate the premises on the ground of the modifications done without permission and non payment of rent. If he does not vacate, then file a suit for eviction against him in the court.
