Tenant's issues

hello there, here is the case:

tenant rented a property in year 2009 (as per 11 month standard lease agreement, to be renewed after every 11 months, which was never renewed, but same tenant continued till date, rent was paid in cash, hence no receipt are there). in last week of may 2013, the property was sold and hence tenant was asked by lease owner (original landlord) to vacate the property in a day or two.

tenant request the landlord (who had given property on lease) that some time is needed to shift, but the same continued "vacate now", meantime tenant lost his father (natural death) and shifting delayed by one month. in june landlord called upon SDM of the place and SDM without listening the two passed order vacate by 30th of this month and finally tenant approached the acjm court and "stay" was granted to tenant.

meantime, the new buyer of that property, filled an fir at local police station that tenant has unauthorised  possession  on property and also have taken possession on their belongings.

the cops told the tenant, it is bailable offence and must bail out at police station, court has to decide the possession on property of tenant is valid or invalid.

now, what i wish to ask is, how tenant should save his skin? kindly suggest.

regards

if possible try to implead him or else you have to file fresh case against the new buyer.
