Tenent rights

Hello

My father came to mumbai and took a flat on rental basis in the year 1980 with a deposit of rs.7000.

the agreement does not include any tenurity(for eg. 11months,3ys etc) in short it was like the tenant can stay in the house till the time he want's.

As on date we were paying rs. 300/- per month as rent and along with that we were also paying the electricity bills,water bills and maintenance and we have each and every bills with us.

Now for last 6 months owner has increased the rent to rs. 1500/- per month and we refused to pay the rent we just aggreed to pay rs. 500/- per month owner is not agreed and told us to either pay rs. 1500/- per month or vacant the room.so for last six months owner is not taking the rent not even rs. 300/-so last six month rent is due on us.

so just require legal response can he forcefully do this with the tenant.

pls assist for the other way around so that we should not be in a fault for not paying the interest for last six months.

It is not normally easy for the landlord to evict the tenant but if the tenant does not pay rent then it can become a valid ground to get the tenant evicted. Therefore never give opportunity to the landlord to prove that the tenant is not paying rent. Either give the rent to landlord and take the receipt from him or deposit the due rent in the court. Court will decide the fair rent.
