Mine is a strange case, wherein, I was working in state government corporation ltd company (Bangalore Metro Rail Corporation Ltd. on Direct Payrole) as AEE,
There was a lot of Harassment and Corruption happening in the Company due to which, I was being targeted as i was not compliant and they realised i was of no use to them. My Contract was for a period of 3 years, in which i had only completed 1 year and still 2 years were pending. but in total i have worked there for 7 years with contract renewals. Unbearable to tolerate harassment I dropped a mail to my Reporting Chief Engineer, with copy to Director about the Corrupt Practices happening there, to get them off my back with proofs, In response i was handed over a Suspension Order stating I assualted the Chief Engineer at the same time when i have recorded my punches at site, I have taken the screenshot of my punches, My Attendance was disabled shortly afterwards, and Enquiry was ordered on a particular date, for which i received a letter to be present on the day through registered post. I shared the punches with the enquiry committee and submitted proof to prove allegation are false.
During the period i received half salary, for a period of four months and my contract was foreclosed with benefits without giving any notice and also without quoting any reason for foreclosure thereof, and turns out in the File Noting, reason quoted is my performance. I had raised RTI request for my Enquiry report and File Noting, where i got a reply stating no enquiry was initiated against me and information with regards to same is NIL, but i have received half salary in the period I have the following question which i request learned members here can clarify, which will be a great help to me:
1) When i was under suspension, can they terminate me without giving Notice/ revoking my suspension quoting my performance as the reason( For which also i have not been given any show cause Notice or Warning) ?
2) How valid is my Suspension, when there is no enquiry initiated?
3) Will I be under suspension if i am reinstated through Labour Court for my performance? and to get cleared the suspension in Labour Court itself.
