The Advocate paying Tax !!!!!

There was a particular member who shot a query at me

 

" what about the advocates ? They are paid fees in cash, but do they pay tax ? "

 

Well, I do not know about Income Tax.

 

But PROFESSIONAL TAX, based on my observation, I can say

" They MIGHT NOT BE PAYING tax ".

 

This incident happened in the year 2011.

 

At the Commercial taxes Office at Koramangala, Bangalore.

 

I was discussing the classification clause with the Asst.Commissioner.

 

The Asst.Commissioner received a phone call from his superior.

 

Immediately after the call, he called the Inspector into his cabin.

 

He asked him to fetch the list of advocates.

I remember the number.

 

222.

Two Hundreds and Twenty Two.

 

These advocates had neither registered under the Professional Tax Payers category nor were they paying the Professional Tax.

 

The Asst.Commissioner was furious.

 

He asked the Inspector " What were you doing for all these months ?

 

why have you spared these people ?

 

Are you scared ? "

 

The Inspector replied

 

" Sir, that is not the case. I am not scared. But I have sent notices to each of these addresses and even visited around sixty offices.

 

Either the advocates have furnished WRONG ADDRESSES 

 

or

 

The Advocates have vacated those offices and are no more available at that address.

 

Nobody provides us any information about their current address.

 

This is the situation Sir. 

 

What should I Do ? "

There are various laws about professional taxes applicability to advocates, you may strain to know them and then pass your observations/comments.

In replying to your comment,

 

" Tax on Trade, Calling and Profession is enacted by the States.

 

In Karnataka, advocates are exempted from professional tax for ten years from the date of their enrolment. "

Mr. Natarajan Iyer, thanks for the information.  In Tamilnadu I dont  remember or seen  any advocate paying professional tax in any city (which includes this one too).  Planning to to pay atleast hence forth.

Professional Tax in Tamil Nadu

You have  to pay this tax in Tamilnadu as well. However, The process ofprofessional tax payment in Tamilnadu is slightly different. It is charged half yearly in Tamilnadu. The assessment of income is also done half yearly. The slab rate  in Tamilnadu is also given half yearly. Half yearly professional tax is collected from the salary of August and January.

 

Half Yearly Salary

Professional Tax Rate Per 6 Months

Up to 21,000 Nil
21,001 – 30,000 100
30,001 – 45,000 235
45,001 – 60,000 510
60,001 – 75,000 760
75,001 and above 1095

 

It is difficult to submit  PT  online in Tamilnadu. HDFC bank website does mention the e-payment but there is no way forward through the Tamilnadu government’s commercial taxes website. 

 

You can download the form from the website of Chennai corporation and Coimbatore corporation. Chennai corporation website also provides the professional tax form to download.

Thanks for the information, I shall pay the taxes directly by calling on the office of the city municipal corporation of my place of residence/practice. 

Thank you once again for reminding the duty of the citizen, shall confirm you once paid the taxes.
