The plaintiff has filed the suit for partition and separate possession of the HUF properties. The plaint averments show that the agricultural land are converted into non-agricultural i.e., residential purpose. But the Schedule of the plaint contain only Agricultural Land as the descripttion and no boundaries are shown. The defendant, who is the father of the plaintiff, has categorically pleaded that the lands are converted and the open plots are sold out to sevral persons.
Now, the plaintiff has produced some documents which are not concerned to suit properties and he has also failed to produce documents which are necessary for partition.
Whether preliminary decree possible in this suit?
