Threatened by service provider representative

Dear sir,

I am availing internet facility from one of service provider, in month of september it was disconnected due to server issue from there side. We kept on calling customer care for about a week, and was given false commitment, after gud 10 days , some representive call me and he was drunk and started abusing and threatneing me  saying " will come to your place and will cut u in pieces " . I immediately called customer care and logged complain. Post complain I escalted the issue to Nodal officers and next day problem was resolved. I asked for apology letter and wrote mail to the service provider for the same. But we did'nt received any, but they kept on charging with bills.  

As I was abused and was dealt with wrong gesture, more ever I wrote more than twice for apology letter and still not got the same. I want to sue them for mistreating me . And also want to claim compensation for the same. I have all the formal communication on mail, In which they have accepted issue and apologised for inconvenience. But I didin't got any notfication or apology letter stating course of action taken against the said staff. Please suggest

u should mail or send a copy of compalint to the police of the locality concerned.

do they demanded money by keeping u on threat ?

Anand you can send an email with all the email attachments to your area DCP...And may personally go to the area police station and file a complaint, you may lodge a FIR based on the allegation that you've been threatened to be killed..

The conduct of the company is unpardonable. Approach the institutions of NGO’s { List available at TRAI website}, print and electronic media, consumer help portals, police, court of law, govt. regulators, your local councilor, community leaders  etc… and any other you can think of.

It takes patience and perseverance to teach such companies and indivisuals.

The Nodal Officer and Appellate authority being employee of the company do not grant relief you are looking at.

 Your issues are:

  1. The connection was disconnected by company and company should not charge for this period.
  2. The company’s associate/recovery/collection/partner called you and threatened to kill you, and company should supply you the ownership details of the telephone number from which the call was made e.g. name of firm of associate/recovery agency/collection agency/partner and its full address , name with sirname of the prop/director/MD of this company, Manager of internet service provider to whom this agency is reporting, certified copy of emails/letters sent by internet service provider to this agency to contact you, and follow up action taken by internet service provider/inquiry conducted and inquiry report/action taken by company etc…….

You may lodge a complaint in writing with local BM of the company in writing under acknowledgment with seal and signature. If he does not receive the complaint go with crowd of well wishers and ensure that he receives your complaint. Obtain his email id and supply the scanned copy of written complaint as well and demand all details as mentioned at 2. Log onto web site of company and obtain contact details of MD/CEO/Company Secretary and attach copy of complaint lodged with BM and demand details.

Forward copy of your complaint to TRAI, and State Minister of Communication, Registrar of companies. Follow up thru RTI.

You may lodge a complaint in writing addressed to Police Commissioner/SHO of your area and submit it in person to both and demand ownership detail, copy of recorded conversation of call made to you, and other details. You shall be allotted a complaint number. Forward your complaint to DGP and State Minister of Home, Governor. Follow up thru RTI. It shall be helpful as you shall get a reply on inquiry conducted and inquiry report by SHO/Police Commissioner. Don’t enter into compromise.

Another step you may follow is in each SSP/SP/Police Commissioner Office one desk/ personnel has online access and can check ownership detail of each phone number. Apply your resources and obtain it.

If the police does not act or rather enters into malpractices you may look into the option of sending an email/telegramme/fax to Chief Justice of High Court of your state. Let your lawyer draft the matter of this { and preferably let your lawyer draft all your complaints to others too}. In one of similar case a person from o/o Chief Justice was in the city asking on the status, and Police Commissioner/SHO had to appear before Chief Justice and the they were fined Rs.10000/. After that police was extra polite and efficient.

You can also lodge a private complaint, before magistrate. Court and police can obtain call recording.
