Threatening to marry forcefully

Hello I needed advice for a friend of mine. So my male friend happened to meet a girl from religion community app in August 2021. They families met in Jan 2021. April 2022 the girl's extended family came to my Friends house to fix their mrg. May 2022 the girl booked a resort to celebrate my friends bday. The made love to each other. Again in May my Friend booked a resort to celebrate the girls bday. Again they made out. Since July my friend's health had issues n in September he got operated. Now this girls behavior was seen closely by his parents n himself. They didn't like her behavior at all. So my friend decided to call off the wedding n break up with her. September 2022 he already told her that won't be able to marry u n we cannot go further. The girl said ok but didn't give any closure. All of a sudden in March 2023 the girls mother n her started calling my friend n pushed him for marriage, what should he do, please help 🙏

You are talking about the incident that took place three years ago and in between what happened?

Whether the girl side is still pursuing the issue, if so, how did the boy manage all these two years or more.

They are reportedly in Jan 2021 and it is more than four years of their relationship.

The story seems to be fabricated for the purpose of getting an answer for question raised in the academic interest ?

This is real sir they were sending goons for threatening but boy stayed with his NO , and now they say that they will file a rape case

Yes, they can file a rape case. However, it is a question of fact whether the consensual physical relationship constitites the offence of rape or otherwise. This aspect could be ascetained only after due investigation/trial.

Hi Vikas, If this is a real case, your friend must take immediate legal action to protect himself from false allegations and coercion.

Firstly, if the girl’s family is sending goons or making threats, your friend should file a police complaint under Section 506 IPC (criminal intimidation). If they are harassing him at his home, workplace, or through continuous calls, he has the right to seek protection orders from the police. Any form of coercion, whether physical or mental, is a serious offense under the law.


Regarding the threat of a false rape case, it is important to note that the relationship was consensual. A case under Section 376 IPC (rape) will not hold unless the girl falsely claims that consent was obtained through a false promise of marriage. To counter any false accusations, your friend should collect evidence, including WhatsApp messages, call recordings, and any other proof that can establish the consensual nature of the relationship. If a complaint is filed against him, he must immediately apply for anticipatory bail under Section 438 CrPC to prevent arrest.


Additionally, forcing someone into marriage is illegal. If he is being pressurized or blackmailed, he can file a complaint under Sections 503 and 506 IPC, which deal with criminal intimidation. If the harassment continues, a legal notice can be sent to the girl’s family warning them to refrain from making false allegations or coercing him into marriage.


Legal Steps to Take Immediately
 1. File a police complaint under Section 506 IPC for threats and harassment. (and later 156(3))
 2. Collect all relevant evidence proving the consensual nature of the relationship.
 3. If a false rape case is filed, apply for anticipatory bail under Section 438 CrPC.
 4. File a complaint under Sections 503 and 506 IPC if he is being forced to marry.
 5. Consult a criminal lawyer to handle any legal proceedings effectively.

These are Me-Too days. Rape complaints are made years after the alleged incident and courts entertain them.
