judgement debtor is no more while decree hioder wants to proceed against surities in execution. Surities have moved an application for impleading the legal heirs of judgement debtor.but dec ree holder has objected for impleading the legal heirs of judgement debtor.Is it possible that without bringing legal heirs on record the court can proceed against surities.Also the summons were never received by judgement debtor while alive.
