Trademark renewal

A trademark was renewed by the company on 24.02.2003, and the same was valid till 24.02.2010. The same is not renewed till now, but the trademark status is shown as registered, its not removed from the registry .

Meanwhile new owners came to the company and the registered office was changed but the same was not effectuated in trademark.so even if communication was send by registrar to former address, the proreitor was not aware of the same.

How to go about in this matter ??

Can you please tell me if One should get registered as Trade Mark Agent to apply for trademark or trademark Renewal.

Yes, Mr. Rajesh is correct. Now it is 2011 end. Even if you apply for TM renewal it will be abandoned.

Trademark Renewal is a critical step to maintain the legal protection of your brand. In most jurisdictions, trademarks are initially registered for a period of 10 years. To continue enjoying exclusive rights, the trademark owner must file for renewal before the expiration date. Timely renewal ensures that the trademark remains active and enforceable against any potential infringement.

The renewal process typically involves submitting an application to the relevant trademark office, paying the prescribed fee, and in some cases, providing proof of continued use. It's advisable to start the renewal process well in advance of the expiration date, as missing the deadline can result in penalties, additional fees, or even loss of rights. Some jurisdictions offer a grace period after expiration, but relying on it is risky.

Trademark renewal is not just a formality—it preserves the goodwill and reputation associated with your brand. Regular maintenance also strengthens your position if legal disputes arise. It’s best to monitor your trademark portfolio or engage a professional service to track renewal deadlines and handle submissions properly.

Keeping your trademark renewed reflects your ongoing commitment to your brand and protects the valuable asset you've built over time. Connect with professional Trademark Attorney/ Experts like Setindiabiz today to maintain your trademark exclusive rights.
