Transfer fees in case of transfer to blood relative

I have a property in Gandhinagar, Gujarat which was originally purchased by my real brother, but since he had to move to another state due to work purpose, he decided to transfer it to me with some consideration amount. I have two questions 1) Can society charge Transfer fee in case of transfer to blood relative 2) Society has not issued share certificates to members since our society is in legal dispute due to fraud done by the builder and society does not have NOC from authorities. Can society charge transfer fees in this case?

Society can not charge transfer fee when the premises are transferred to blood relation.

No, the Society can not charge any such fees.

Cooperative Soceities Act is a State subject which slightly differ from State to State.

It is advisable to consult and engage a local prudent lawyer for better appreciation of facts/ documents, professional guidance and necessary proceeding.
