Transporter not delivered the goods

Sir we are a transporter and have taken business from another transporter for transporting of goods form pune to chennai. We hired another transporter who has placed the vehicle in pune. We have transferred advance to him. But he has not transferred the advnace fully to individual truck owner. Truck owner not moving the vehicle and client is threatening that they will going to take legal action against us. Whether we can go legally against the person we hired. what is the procedure.

@ Sunlogistics,

It is a commercial dispute between principal and agent, where service of agent is deficient.

You should issue legal notice for transfer of full amount to the owner of truck.

The matter required to be resolved in a time bound manner. Any legal procedure may not be much avail. Every trade has its own norms for dealing with such situations, if necessary, with the assistance of the trade association.

Any how, the primacy ought to be in protecting interest of the client. Inter se dispute among the transporters could be resolved in the due course.
