unregisteted document

Dear experts
in the year 1968 a father executed a doument regarding his land in favor of her daughter and her brother also one of the attester on the same and since then she is enjoying with the peaceful possession. now her brother who attested on the document objecting and trying to grab the same
filed the case and court is considering to mark the same though it is 30 yers back as it is unregistered.
kindly advice on this issue.

attesting witness must be at least two. one attestation is not legally tenable.

The land is ancestral or self acquired of father.if khata has been changed on that unregistered deed MR etc to her name fifty years long adverse possession shall be claimed.

If it is. Unregistered then duty penalty has to be paid before marking.object it.
