can a son or daughter alone take money out of the ATM of deceased father without informing the bank or other legal heirs?if not what are the consequences and what are the sections of IPC under which FIR should have been lodged?Please reply,if any similar case law is available,Please quote the same

My cousin brother(Uncle's Son) had withdrawn through ATM of my grandfather after his death without informing anyone. Now i want to lodge FIR against him for his act, but when i approached the Police Station and complained against him police officials said it is of civil nature and you should move to civil court for the recovery.He had not done any offence.Please guide....

Police is wrong. It is a fraud case.
