Hi Friends,
My sister-in-law has filed a false case of IPC 498A, 307 and many others against my brother and the entire family, inspite of the fact that she was staying with her parents since 3 years and never stayed with me as I was always away in different cities working for my employers. She has no contacts with me since 3 years, even then she took my name in the FIR just to harass our family.
As of now, we have got the stay of arrest from Allahabad High Court and the case has gone into meditaion. I have following doubts:
a) How can I come out of this mess? Can I apply for quash even though the case is in meditation?
b) If mediation fails, then what will happen to stay of arrest?Can we apply bail directly in High Court even the case is pending in lower court?
c) Since my sister-in-laws family is quite influential, can we avoid the hearing in session court because they have bribed/pressurised the judge it seems.
d) What all I can do till the mediation result is out.
Please help!!
